Terms of service

Version 2026-10 · Effective October 7, 2026

Respara is a tool for writing and maintaining Emergency Action Plans. It does not provide medical direction, and it does not make your plan correct — the people who run your program are responsible for reviewing every plan before it is posted or relied on.

1. Who this agreement is between

These terms govern your organization's use of Respara ("the platform"), which is provided by Team21 Training & Recovery ("we", "us"). "You" means the organization that holds the workspace, and each person who signs in to it.

Whoever accepts these terms confirms they are authorized to do so on behalf of their organization. If you are not authorized to enter into agreements for your school, district, club or department, stop here and pass this to someone who is.

2. What the platform is, and what it is not

The platform helps you write, store, update and print Emergency Action Plans and the documents that go with them. The default protocol text is drawn from published National Athletic Trainers' Association guidance and is provided as a starting point for you to edit.

It is a documentation tool. It is not a medical device, not a monitoring or alerting service, and not a substitute for medical direction, professional judgment, or a call to emergency services. Nothing in it is medical, legal or safety advice, and it certifies nothing.

  • Every plan must be reviewed for accuracy and completeness by qualified medical and administrative personnel before it is posted or relied on.
  • Requirements differ by state, by athletic association, by league and by insurer. Checking what applies to you, and meeting it, is your responsibility.
  • In an emergency, call your local emergency number. The platform plays no part in an actual response.

3. Your content stays yours

Everything you put into the platform — your venue plans, maps, photographs, personnel details, logos and records — remains yours. We claim no ownership of it.

We use it to run the service for you: storing it, serving it back to you, generating your documents, and backing it up. We do not sell it, and we do not use it to train machine-learning models.

One exception, which you are asking for when you use it: if you upload an existing plan to be read into a draft, that document is sent to our AI provider to extract its contents. Do not upload a document containing information you are not willing to have processed that way.

4. Accounts, access and who can see what

Each workspace belongs to one organization. You control who you invite into it and what role they hold, and you are responsible for what the people you invite do with that access.

Keep your sign-in credentials to yourself. Tell us promptly if you believe an account has been compromised. Remove people who have left your program — we cannot know that a coach has moved on.

5. Subscription, payment and renewal

The platform is sold as an annual subscription per organization, at the tier you select, plus a one-time setup fee on your first invoice. Prices are those shown at the time you subscribe.

Subscriptions renew annually unless cancelled before the renewal date. Card payments are processed by Stripe; we never see or store your card number. Purchase orders are accepted, and access begins when the invoice is issued rather than when payment clears.

You may cancel at any time, effective at the end of the period you have paid for. We do not refund a period already begun, and we do not bill you again after you cancel.

6. If a subscription lapses

If a subscription lapses, your workspace becomes read-only for a grace period, and after that editing is locked. Two things do not change: you can always read your plans, and you can always export them. We will not hold a school's emergency documents hostage over an unpaid invoice.

Workspaces that stay locked are subject to the data retention policy in section 8.

7. Acceptable use

Do not use the platform to:

  • Store data for an organization you are not authorized to act for.
  • Upload material you do not have the right to use, including copyrighted maps, photographs or documents belonging to someone else.
  • Attempt to reach another organization's workspace, probe or interfere with the service, or work around its access controls or rate limits.
  • Resell, sublicense or white-label the platform without a written agreement with us.
  • Store information the platform is not built for — protected health information about identifiable patients, student records subject to FERPA, payment card numbers, or government identification numbers. Plans need roles and locations, not diagnoses.

8. Keeping your data, and getting it back

You can export every document the platform produces at any time, in any subscription state, and we intend to keep it that way. Export before you cancel.

We keep the data of a locked workspace for twelve months from the date it locked, so a program that misses a renewal over a summer does not lose its plans. Before anything is deleted we send written notice to the workspace's billing address, at least thirty days ahead. After that period the workspace and its uploaded files are permanently deleted, and a record that the deletion happened is retained.

You may ask us to delete your workspace sooner. We will do it, and it cannot be undone.

9. Availability

We work to keep the platform available and we take backups, but we do not offer a guaranteed uptime figure and we are not going to invent one. The service may be unavailable for maintenance, or because of a failure at a provider we depend on.

This is the practical consequence, and it matters more than the paragraph above: your Emergency Action Plan must exist off the platform too. Print it. Post the sign at the venue. Put the binder somewhere your staff can reach without a phone, a login, or a working internet connection. A plan that can only be read when a website is up is not a plan.

10. Disclaimers and limits on liability

The platform is provided "as is". To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or business interruption. Our total liability arising out of or relating to these terms or the platform, for any and all claims, is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

You remain responsible for the content and accuracy of your plans, and for the conduct of an actual emergency response.

11. Changes to these terms

We may update these terms. When we do, we bump the version and ask each person to accept the new text the next time they sign in — we do not change the deal silently and leave you to find out.

We also ask you to re-accept once a year, and again after a renewal, so agreement to what you are using stays current rather than being something a departed athletic director clicked in 2024.

If you do not accept updated terms, you can still export your documents, and you can cancel. Continuing to use the platform means accepting them.

12. Ending the agreement

You can stop using the platform at any time. We may suspend or end access if these terms are breached — including for non-payment or for the acceptable-use rules in section 7 — and where the circumstances allow it we will tell you first and give you a chance to put it right.

Sections 3, 8, 10 and 13 survive the end of this agreement.

13. General

These terms are the whole agreement between us about the platform, and they replace any earlier version you accepted. If a provision is unenforceable, the rest still stands. Our not enforcing something once does not waive it.

You may not assign this agreement without our consent; we may assign it as part of a merger or sale of the business.

These terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws rules, and the state and federal courts located in Kentucky are the venue for any dispute arising out of them.

14. Contact

Questions about these terms, a deletion request, or anything else: reach Team21 Training & Recovery through the contact details on our About page. We would rather hear from you than have you guess.
